1. Legal information and acceptance

This Legal Notice regulates the use of this web-site Aliustudio.com (hereinafter also, ‘the Shop’). 

As legal representative of the company ALIU STUDIO, Juan Querol Soler, with DNI 39902651C, and fiscal address at calle Annibal 5, 08004, Barcelona.

Acceptance of this Legal Notice implies that the User is aware of its terms and undertakes to comply with them. Under no circumstances does ALIU STUDIO guarantee the availability or maintenance in the future of the services accessible through the shop. ALIU STUDIO may at any time decide to interrupt, suspend or definitively cancel this Shop.

Orders placed by users through this shop are subject to the general conditions of purchase (hereinafter, the ‘General Conditions of Purchase’). These General Conditions of Purchase constitute the main legal document of the contract of sale and they regulate the rights and duties of users as customers of ALIU STUDIO. It is therefore advisable that before starting to make purchases in our shop, users should carefully read these General Conditions of Purchase. ALIU STUDIO can modify these General Conditions of Purchase at any time. The modifications made will not affect, in any case, the purchases that users have made prior to the approval of these modifications which will be governed in any case by the General Conditions in force at the time of making those other purchases. It is the responsibility of the User to be aware of the General Conditions of Purchase in force at the time of initiating the Purchase Process.

The General Conditions of Purchase as well as the other documents of the purchase contract are available in English and Spanish.

 

2. Intellectual Property

All the contents of the Shop, understood to include but not limited to text, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the ‘Content’), are the intellectual property of ALIU STUDIO, and none of the exploitation rights recognised by current legislation on intellectual property may be understood to have been transferred to the Users. 

The brands, commercial names or distinctive signs are the property of ALIU STUDIO, and it may not be understood that access to the shop confers on users any rights over the aforementioned brands, commercial names and/or distinctive signs.

 

3. Conditions of use of the Online Shop

3.1. GENERAL

Users of the Online Shop are obliged to make proper use of the Shop in accordance with the Law and this Legal Notice. Users who fail to comply with the Law or this Legal Notice will be liable to ALIU STUDIO or third parties for any damages that may be caused as a result of failure to comply with this obligation.

It is expressly forbidden to use the Store for purposes harmful to property or interests of ALIU STUDIO, or in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and applications (software) ALIU STUDIO or third parties.

3.2. CONTENTS

The clients of the shop undertake to use the contents in accordance with the law and this legal notice, as well as with the other conditions, regulations and instructions that may be applicable to certain services as established in clause 1. By way of example only, customers shall refrain from:

Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the contents, except in cases permitted by law or expressly authorised by ALIU STUDIO or by whoever holds the exploitation rights in each case.

Reproduce or copy for personal use the contents that may be considered as software or databases in accordance with current legislation on intellectual property, as well as its public communication or making it available to third parties when these acts necessarily imply the reproduction by the client or a third party.

Extract and/or reuse all or a significant part of the contents of the shop, as well as the databases that ALIU STUDIO makes available to customers.

3.3. FORM

Without prejudice to the provisions of clause 6 of this Legal Notice, the use of certain services or applications is conditional upon the prior completion of the corresponding user registration.

All information provided by the user through the shop forms for the aforementioned or other purposes must be truthful. In this respect, the user guarantees the authenticity of all the data he/she communicates and will keep the information provided perfectly updated so that it corresponds, at all times, to the user's real situation. In any case, the user will be solely responsible for any false or inaccurate statements made and for any damage caused to ALIU STUDIO or third parties as a result of the information provided.

 

3.4. INTRODUCTION OF LINKS TO THE SHOP

Internet users or information society service providers who wish to include links from their own web pages to the shop must comply with the conditions explained below:

The link may only link to the homepage of the shop, without reproducing it in any way (inline links, copying of texts, graphics, etc.). Web 2.0 type interaction systems offered from the shop to link to the shop are excepted from the above.

It is forbidden, in accordance with current legislation, to establish frames of any kind that surround the shop or allow the contents to be viewed through Internet addresses other than those of the shop and, in any case, when they are displayed in conjunction with content outside the shop in such a way that: (i) produces, or may produce, error, confusion or deception in users about the true origin of the service or content; (ii) implies an act of unfair comparison or imitation; (iii) serves to take advantage of the reputation of the brand and prestige of ALIU STUDIO; or (iv) in any other way is prohibited by current legislation.

The page that introduces the link will not make any type of false or incorrect statement about ALIU STUDIO or its partners, employees, members or about the quality of the services we offer.

Under no circumstances will it be expressed on the page where the link is located that ALIU STUDIO has given its consent for the insertion of the link or that it in any way sponsors, collaborates with, verifies or supervises the services of the sender.

The use of any word, graphic or mixed brand or other distinctive sign of ALIU STUDIO within the sender's page is prohibited, except in cases permitted by law or expressly authorised by ALIU STUDIO and provided that, in these cases, a direct link to the shop is permitted in the manner established in this clause.

The page that establishes the link must strictly comply with the law and may not under any circumstances provide or link to its own or third party content that: (i) is illicit, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (ii) induces or leads to the creation of a link to the shop. ); (ii) induce or could induce in the user the false conception that ALIU STUDIO has commercial relations with, endorses, adheres to or in any way supports the ideas, statements or expressions, licit or illicit, of the sender; (iii) are inappropriate or not pertinent to the activity of ALIU STUDIO in view of the place, content and subject matter of the sender's web page.

4. Exclusion of responsibility

4.1. QUALITY OF SERVICE

Access to the shop does not imply any obligation on the part of ALIU STUDIO to guarantee the complete absence of any harmful computer element from third parties (‘malicious software’ or ‘malware’) during browsing. It is the user's responsibility to have adequate tools for the detection and elimination of harmful computer programs.

ALIU STUDIO is not responsible for any damage caused to the computer equipment of users or third parties by acts of third parties during the provision of the shop service.

4.2. AVAILABILITY OF THE SERVICE

Access to the Shop requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, security, continuity and operation is not the responsibility of ALIU STUDIO. Consequently, the services provided through the Shop may be suspended, cancelled or become inaccessible, prior to or simultaneously with the provision of the Shop service without the need for prior notification by ALIU STUDIO. Notwithstanding the foregoing, in the event that for any reason, ALIU STUDIO definitively cease to provide the services of the Store, ALIU STUDIO will make every effort to notify Registered Users of such an incident.

ALIU STUDIO, will not be responsible for damages of any kind caused to the User as a result of failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the shop service during the provision of the same or prior to it.

 

4.3. CONTENTS AND SERVICES LINKED THROUGH THE SHOP

The shop may contain links which allow the user to access other Internet sites and portals (hereinafter ‘linked sites’). In these cases, ALIU STUDIO acts as a provider of intermediary services in accordance with article 17 of Law 34/2002, of 11th July, on Information Society Services and Electronic Commerce (‘LSSI’) and will only be responsible for the contents and services offered on the linked sites to the extent that it has effective knowledge of their unlawfulness and has not deactivated the link with due diligence. In the event that the user considers that there is a linked site with illegal or inappropriate content, he/she may notify ALIU STUDIO in accordance with the procedure and effects established in clause 6 of this legal notice, without this notification in any case implying the obligation to remove the corresponding link.

Under no circumstances should the existence of linked sites be interpreted as the existence of agreements with the managers or owners of the same, nor as a recommendation, promotion or identification of ALIU STUDIO with the statements, content or services provided.

ALIU STUDIO has no knowledge of the contents and services of the linked sites and, therefore, is not responsible for any damage caused by the unlawfulness, quality, outdatedness, lack of availability, error or uselessness of the contents and/or services of the linked sites or for any other damage that is not directly attributable to ALIU STUDIO for its own services.

4.4. CONFIDENTIALITY OF THE INFORMATION STORED IN THE SHOP

ALIU STUDIO has the security measures required by law to guarantee the confidentiality and secrecy of the personal data provided by users. Notwithstanding the above, the transmission of such data to ALIU STUDIO circulates through third party telecommunications networks not controlled by ALIU STUDIO, such as our postal service. In addition, you may have some type of malicious software on your own equipment which is beyond our reach and which provides your data to third parties.

ALIU STUDIO is not responsible for the lack of confidentiality of the information provided by third party equipment and networks nor for the vulnerabilities of software/hardware on the Users' own equipment.
